Terms of Service

1. Acceptance of Terms

By using Lenci ("the Service"), you accept these Terms and our Privacy Policy. These Terms constitute a binding legal agreement between you and Siyada Technology ("we", "us", "the Company"), registered in Riyadh, Kingdom of Saudi Arabia.

2. Description of Service

Lenci provides AI-powered fashion photography, product imaging, and video generation, including:

• AI-generated model photography.
• Product image enhancement and commercial imagery.
• Image-to-video content creation.
• AI-powered editing and manipulation tools.

3. Eligibility

To use the Service, you must be at least 18 years old and have full legal capacity to contract. The Service is not available to minors.

4. Account and Security

To access full features, you must create an account. You are responsible for:

• Keeping your login credentials confidential.
• All activities that occur under your account.
• Notifying us immediately at support@lenci.ai on any suspected unauthorized use.
• Not sharing account credentials with any third party.

5. Credits and Payments

The Service runs on a credit system. Credits are granted on purchase and consumed when you use image and video generation features, per the prices published on the pricing page.

• Payment is processed by Network (a PDPL-compliant payment service provider), in Saudi Riyal (SAR) or any approved currency on the checkout page.
• Credits do not expire while your account remains active.
• We may update prices with at least 14 days' prior notice via your registered email.

6. Refunds

Consumed credits are non-refundable. For unused credits, you may request a refund within 14 days of purchase provided none have been used in a generation. Send your request to support@lenci.ai. Refunds are processed within 7 business days.

7. Your Content and Licenses

7.1 Uploaded Content

You retain all rights to the content you upload (images, prompts). By sharing the content with the Service, you grant us a limited, non-exclusive license to process it for the purpose of delivering the Service to you.

7.2 Generated Content

Content generated by the Service is licensed to you under a broad commercial use license, with the exclusions described in Section 8 (Prohibited Uses).

7.3 Consent to Use Images Featuring Individuals

Before uploading any image featuring another person, you must have obtained their explicit consent. You bear full responsibility for any dispute arising from the use of images without their subjects' consent.

8. Prohibited Uses

The Service must not be used for any of the following:

• Any activity violating the laws of the Kingdom of Saudi Arabia.
• Creating misleading, fraudulent content, or content intended to impersonate a real person (deepfakes of individuals without their consent).
• Infringing third-party intellectual property rights.
• Generating pornographic, violent, hate-inciting content, or content offensive to religion or public morals in the Kingdom of Saudi Arabia.
• Targeting minors with inappropriate content.
• Attempting unauthorized access, hacking, or abuse of the technical infrastructure.
• Reselling or redistributing the Service's outputs as a competing "AI service" without our written consent.

9. AI-Generated Content and Transparency

AI-generated content ("synthetic media") may be indistinguishable from real content. When using the Service's outputs in commercial or media contexts, we encourage you to disclose that the content is AI-generated, per industry best practices and any future local regulatory requirements.

10. Company Intellectual Property

All intellectual property rights to the platform (code, design, logos, models, interfaces) are reserved to Siyada Technology. You are not granted the right to use any company trademark or asset without written permission.

11. Service Availability and Disclaimer

The Service is provided "as is" and "as available", without any express or implied warranties. We do not guarantee 100% uptime or freedom from errors. The Service may be subject to scheduled or emergency maintenance.

12. Limitation of Liability

To the maximum extent permitted by law, Siyada Technology shall not be liable for:

• Any indirect, incidental, consequential, or special damages.
• Loss of profits, reputation, or data.
• Your use of AI outputs in a way that infringes the rights of others.

The Company's total liability for any claim shall not exceed the total amount you paid for the Service in the 12 months preceding the event.

13. Indemnification

You agree to indemnify Siyada Technology against any claims or damages arising from your violation of these Terms or of third-party rights, including reasonable attorneys' fees.

14. Termination

You may terminate your account at any time from account settings. We may suspend or terminate your account in case of:

• Violation of these Terms or the Privacy Policy.
• Suspected fraudulent or abusive use.
• Legal orders or regulatory requirements.

On termination, your data is deleted according to the retention schedule described in the Privacy Policy.

15. Privacy Policy

Processing of your personal data is governed by the Privacy Policy, which forms an integral part of these Terms.

16. Modification of Terms

We may update these Terms to reflect changes in the Service or in legal requirements. We will notify you of material changes at least 14 days before they take effect, via email and/or an in-app notice. Your continued use of the Service after the update takes effect constitutes acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Kingdom of Saudi Arabia. The commercial courts of Riyadh shall have exclusive jurisdiction over any dispute arising out of these Terms or your use of the Service, with prior encouragement to resolve disputes amicably by direct contact with legal@lenci.ai.
